Equipment Rental Terms and Conditions

These Terms and Conditions govern the rental of equipment and related accessories from CJI Systems Ltd (“Supplier”, “we”, “us”, or “our”).
By making a booking, paying a rental fee, paying a deposit, collecting equipment, accepting delivery, or using the equipment, the Customer agrees to be bound by these Terms and Conditions.
1. Definitions
"Customer" means the individual or organisation renting equipment from the Supplier. "Equipment" means any equipment, devices, hardware, tools, accessories, components, carry cases, power supplies, cables, mounts, and related items supplied by the Supplier. "Rental Period" means the period agreed between the Customer and the Supplier. "Security Deposit" means the refundable deposit required before equipment is released.
2. Rental Fees
2.1 All rental fees must be paid in full before equipment is collected, dispatched, or delivered unless otherwise agreed in writing. 2.2 Rental fees are charged according to the rental package selected. 2.3 Rental periods commence on the agreed start date and end on the agreed return date. 2.4 Equipment returned after the agreed return date may incur additional rental charges and late fees. 2.5 All prices are quoted in New Zealand Dollars (NZD) unless otherwise stated.
3. Security Deposit and Credit Card Authorisation
3.1 A Security Deposit may be required for any rental. 3.2 The deposit amount will be advised at the time of booking. 3.3 The Security Deposit is held as security against: • Loss or theft of equipment • Damage beyond normal wear and tear • Missing accessories • Late return charges • Unpaid rental charges • Cleaning costs where equipment is returned excessively dirty • Any breach of these Terms and Conditions 3.4 The Customer authorises the Supplier to obtain a credit card or debit card pre-authorisation or hold on the payment card supplied at the time of booking. 3.5 The Customer further authorises the Supplier to charge the nominated card for: • Outstanding rental charges • Late return fees • Missing equipment • Damage repair costs • Replacement costs • Freight and recovery costs • Reasonable debt collection and recovery expenses 3.6 Any remaining Security Deposit will be refunded within five (5) business days following inspection of the returned equipment.
4. Cancellation Policy
4.1 All cancellations must be submitted in writing via email. 4.2 Cancellation charges apply as follows: More than 7 days before the rental start date: • Full refund of rental fees • Full refund of Security Deposit 3 to 7 days before the rental start date: • 50% of rental fees retained • Security Deposit refunded in full Less than 72 hours before the rental start date: • 100% of rental fees retained • Security Deposit refunded in full After equipment has been collected, dispatched, or delivered: • No refund available 4.3 Requests to change rental dates are subject to availability and are granted at the Supplier's sole discretion. 4.4 Failure to collect equipment without prior notice will be treated as a cancellation within 72 hours of the rental commencement date. 4.5 The Supplier reserves the right to cancel a booking where: • Payment has not been received • Identity verification requirements have not been met • Equipment becomes unavailable • The Supplier reasonably believes the equipment may be at risk • The Customer has previously breached these Terms and Conditions Where the Supplier cancels a booking, all monies paid by the Customer will be refunded in full.
5. Customer Responsibilities
5.1 The Customer is responsible for the equipment from the time it is collected, delivered, or dispatched until it is returned and accepted by the Supplier. 5.2 The Customer agrees to: • Use the equipment responsibly and only for its intended purpose • Follow all operating instructions supplied • Take reasonable care of the equipment • Keep equipment secure from theft, loss, or damage • Protect equipment from excessive weather exposure • Not modify, repair, alter, dismantle, or tamper with any equipment 5.3 The Customer must immediately notify the Supplier of any damage, theft, loss, malfunction, or incident involving the equipment. 5.4 No Sub-Renting or Transfer The Customer must not lend, sub-rent, assign, transfer, lease, or otherwise provide the equipment to any other person or organisation without the Supplier's prior written consent. The Customer remains fully responsible for the equipment and all obligations under these Terms and Conditions for the entire Rental Period, regardless of whether another person uses or possesses the equipment. 5.5 International Travel Restrictions Equipment rented from the Supplier must not be taken outside New Zealand without the Supplier's prior written consent. The Customer is responsible for ensuring compliance with all applicable customs, import, export, telecommunications, and regulatory requirements if approval is granted for overseas use. Any loss, theft, damage, seizure, confiscation, delay, or additional costs arising from international travel or transport of the equipment will be the sole responsibility of the Customer. The Supplier reserves the right to refuse any request to take equipment outside New Zealand. 5.6 Ownership of Equipment All equipment supplied by the Supplier remains the sole property of CJI Systems Ltd at all times. The Customer acquires no ownership rights, title, or interest in the equipment by virtue of this rental agreement. The Customer must not sell, pledge, mortgage, charge, encumber, or otherwise deal with the equipment in any manner inconsistent with the Supplier's ownership.
6. Loss, Theft and Damage
6.1 The Customer assumes full responsibility for all equipment during the Rental Period. 6.2 Any loss, theft, accidental damage, or malfunction must be reported to the Supplier immediately. 6.3 Where theft is claimed, the Supplier may require a police report and supporting evidence. 6.4 The Customer is liable for all repair or replacement costs arising from loss, theft, damage, misuse, negligence, improper storage, unauthorised modification, or failure to return equipment. 6.5 Equipment Replacement Values The Customer acknowledges and agrees that replacement values are based on the Supplier's current replacement costs at the time of loss or damage. The Supplier maintains a current replacement value schedule for all rental equipment and accessories. Replacement values are available upon request and may be updated from time to time without notice to reflect market pricing and replacement costs. Where equipment is lost, stolen, destroyed, or damaged beyond economical repair, the Customer will be liable for the applicable replacement value together with any associated freight, installation, configuration, sourcing, administration, and recovery costs reasonably incurred by the Supplier. 6.6 Where equipment can be repaired, the Customer will only be charged the reasonable cost of repair together with any associated freight, replacement equipment hire, technician, or service costs. 6.7 If replacement or repair costs exceed the value of the Security Deposit, the Customer remains liable for the balance.
7. Equipment Performance
7.1 The Supplier will make reasonable efforts to ensure equipment is operational before release. 7.2 The Supplier does not guarantee: • Availability of any service connected to the equipment • Network performance • Data speeds • Service continuity • Coverage at any specific location • Compatibility with third-party systems 7.3 Performance may be affected by environmental conditions, weather, interference, telecommunications outages, supplier outages, geographical limitations, or factors outside the Supplier's control. 7.4 The Supplier shall not be liable for any losses resulting from interruptions, downtime, equipment limitations, or third-party service failures.
8. Delivery and Return
8.1 Equipment must be returned by the agreed return date and time. 8.2 Equipment must be returned complete, clean, and in substantially the same condition as supplied, allowing for fair wear and tear. 8.3 Missing accessories may incur replacement charges. 8.4 Late returns may incur: • Additional daily rental charges • Administration fees • Charges for bookings impacted by the delay 8.5 Equipment not returned within seven (7) days of the agreed return date may be deemed lost and the Customer may be charged the applicable replacement value.
9. Identity Verification
9.1 Before equipment is released, the Supplier may require: • Government-issued photo identification • Proof of residential address • A valid credit or debit card in the Customer's name 9.2 The Supplier may refuse to release equipment where satisfactory identification cannot be provided.
10. Limitation of Liability
10.1 To the maximum extent permitted by law, the Supplier is not liable for: • Loss of income • Loss of profits • Business interruption • Loss of contracts • Loss of data • Consequential losses • Indirect losses • Third-party claims 10.2 The Supplier's total liability under any claim shall not exceed the rental fees paid by the Customer.
11. Privacy
11.1 Personal information collected by the Supplier may be used for: • Processing bookings • Identity verification • Equipment tracking • Customer communications • Debt recovery • Fraud prevention 11.2 Customer information will be handled in accordance with the Privacy Act 2020 and other applicable New Zealand laws.
12. Debt Recovery
12.1 The Customer is responsible for all reasonable costs incurred by the Supplier in recovering unpaid amounts, including: • Debt collection agency fees • Legal costs • Court filing fees • Disputes Tribunal costs • Administrative costs
13. Force Majeure
13.1 The Supplier shall not be liable for any delay or failure to perform its obligations where such delay or failure arises from events beyond its reasonable control, including but not limited to: • Natural disasters • Severe weather events • Transport disruptions • Government actions or restrictions • Supplier shortages • Telecommunications outages • Internet outages • Power outages • Civil unrest
14. Consumer Guarantees Act
14.1 Where the Customer acquires equipment for business purposes, the parties agree that the Consumer Guarantees Act 1993 shall not apply to the fullest extent permitted by law. 14.2 Where the Customer is a consumer, nothing in these Terms and Conditions excludes, restricts, or modifies any rights or remedies available under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or any other applicable New Zealand legislation.
15. Governing Law
15.1 These Terms and Conditions are governed by the laws of New Zealand. 15.2 Any dispute arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of New Zealand courts and tribunals.
16. Acceptance of Terms
By placing a booking, paying any fee, paying a Security Deposit, collecting equipment, accepting delivery of equipment, or using the equipment, the Customer confirms that they have read, understood, and agree to these Terms and Conditions. The Customer further acknowledges that: • They are at least 18 years of age; • They are authorised to enter into this agreement; • The information provided during booking is accurate and complete; • They accept responsibility for the equipment throughout the Rental Period; and • They agree to pay any charges arising under these Terms and Conditions.
